מבוא
ברוכים הבאים ל-STEREOIMAGE.
כל שימוש באתר החברה או בשירותיה מהווה הסכמה מלאה לתנאי תקנון זה.
התקנון מנוסח בלשון זכר מטעמי נוחות בלבד, אך מתייחס לכל המגדרים.
1. השירותים
1.1 החברה מספקת שירותי הקלטה, צילום, עריכה ואספקת תוכן.
1.2 כל הזמנה כפופה לזמינות האולפן.
1.3 השירותים מיועדים לבגירים בעלי אמצעי תשלום תקף.
1.4 החברה רשאית להפסיק או לסרב להעניק שירות, לפי שיקול דעתה.
2. תשלומים
2.1 התשלום יתבצע בהתאם למסמך ההזמנה או לקישור התשלום.
2.2 לא יתקבלו תשלומים באיחור ללא אישור מראש.
2.3 השירות יינתן רק לאחר השלמת התשלום במלואו.
2.4 אלא אם צוין אחרת, המחירים אינם כוללים מע"מ.
3. ביטולים ודחיות
3.1 ניתן לבטל או לדחות הקלטה עד שני ימים קלנדריים מלאים לפני מועד ההקלטה.
3.2 ביטול עד שני ימים מראש – החזר מלא.
3.3 ביטול יום לפני ההקלטה – החזר של 50%.
3.4 ביטול ביום ההקלטה – ללא החזר.
3.5 לא יינתן החזר עבור שירות שבוצע בפועל.
ביטול מצד החברה
3.6 החברה רשאית לבטל או לדחות שירות בהודעה של לפחות שעתיים מראש.
3.7 במקרה כזה יינתן החזר מלא או מועד חלופי, לפי בחירת הלקוח.
3.8 ההחזר או המועד החלופי יהוו פיצוי מלא וסופי.
4. איחור לקוח
4.1 הלקוח מתחייב להגיע במועד שנקבע.
4.2 זמן האיחור ייחשב כחלק מזמן ההזמנה.
4.3 לא יינתן זיכוי, הארכה או החזר עקב איחור.
4.4 החברה אינה מתחייבת להשלים זמן שאבד עקב איחור.
4.5 איחור של מעל 30 דקות ללא עדכון מראש עשוי להיחשב כאי-הגעה.
4.6 במקרה כזה החברה רשאית לבטל את ההקלטה ללא החזר.
5. אספקת חומרים
5.1 חומרי הגלם יסופקו בתוך עד 7 ימי עסקים ממועד ההקלטה.
5.2 מוצר ערוך יסופק בתוך עד 14 ימי עסקים ממועד קבלת הערות הלקוח.
5.3 כל סבב תיקונים מחדש את מניין ימי העבודה.
6. שמירת קבצים ואחריות הלקוח
6.1 כל קובצי ההקלטה (וידאו ואודיו) נשמרים למשך עד 30 ימים קלנדריים ממועד ההקלטה.
6.2 בתום התקופה יימחקו הקבצים לצמיתות ללא אפשרות שחזור.
6.3 האחריות להורדת הקבצים, גיבויים ושמירתם חלה על הלקוח בלבד.
6.4 איכות ומהירות ההורדה תלויות בתשתית האינטרנט של הלקוח.
6.5 עם קבלת הקבצים מאשר הלקוח כי קיבל אותם לשביעות רצונו.
6.6 החברה אינה אחראית לכל אובדן קבצים, מידע או נזק ישיר או עקיף, לרבות נזקים כספיים, מסחריים או מוניטיניים.
6.7 קבצים זמניים, סקיצות או קבצי Preview עשויים להימחק אף לפני תום תקופת השמירה.
7. פרטיות ואבטחת מידע
7.1 מידע אישי ישמש לצורך מתן השירות בלבד.
7.2 מידע לא יועבר לצד שלישי אלא אם נדרש על פי דין.
7.3 החברה נוקטת באמצעי אבטחת מידע מקובלים.
7.4 החברה רשאית לחסום משתמשים במקרה של שימוש לרעה.
8. שימוש בחומרים לצרכי שיווק
8.1 אישור ההזמנה מהווה הסכמה לשימוש בחומרי ההקלטה לצרכי שיווק החברה.
8.2 הלקוח רשאי להתנגד בכתב בתוך 5 ימי עסקים ממועד ההקלטה.
8.3 בהיעדר התנגדות תיחשב הסכמה מלאה.
9. חבילות הקלטה
9.1 חבילות הן רכישת שעות מראש.
9.2 שעות שלא נוצלו אינן ניתנות להחזר, להעברה או להארכה.
9.3 ניתן לבטל חבילה בתוך 14 ימים כל עוד לא נעשה בה שימוש.
9.4 במקרה של שימוש חלקי יחושב קיזוז לפי מחיר השעה הרגיל.
9.5 ביטול יום לפני ההקלטה יחויב בשעה אחת מהחבילה.
9.6 ביטול ביום ההקלטה ייחשב כשעה שנוצלה.
9.7 החבילה אישית ואינה ניתנת להעברה.
9.8 החבילות הן מוצר Prepaid ואינן מנוי.
10. מצב ביטחוני וכוח עליון
10.1 השירות ניתן בכפוף להנחיות פיקוד העורף, משטרת ישראל וכל רשות מוסמכת.
10.2 החברה רשאית לדחות, לשנות, לקצר או לבטל הקלטות עקב מצב ביטחוני, אזעקות, אירועי חירום, מגבלות תנועה, תקלות תשתית, כוח עליון או כל נסיבה שאינה בשליטתה.
10.3 מדיניות הביטולים הרגילה של החברה תמשיך לחול, כאשר כל בקשה תיבחן בהתאם לנסיבות.
10.4 החברה אינה מתחייבת לרציפות השירות, זמינות האולפן, איכות ההקלטה, שלמות חומרי הגלם או תקינות מערכות החשמל, האינטרנט, התקשורת והציוד.
10.5 החברה לא תהיה אחראית לכל עיכוב, הפסקה, ירידה באיכות, אובדן נתונים, אובדן חומרי גלם או כל נזק הנובע מהמצב הביטחוני או מאירועי כוח עליון.
10.6 במקרה של אזעקה או אירוע חירום, החברה רשאית להפסיק את ההקלטה באופן מיידי ולהורות על מעבר למרחב מוגן או פינוי המקום.
10.7 במקרים אלו לא יהיה זכאי הלקוח לפיצוי, החזר או כל דרישה אחרת.
10.8 החברה רשאית, אך אינה מחויבת, להציע מועד חלופי להשלמת ההקלטה, בהתאם לזמינות.
10.9 הלקוח מאשר כי הגעתו לאולפן בתקופה זו נעשית על אחריותו האישית בלבד.
11. קניין רוחני
כל זכויות הקניין הרוחני באתר, בתכנים ובשירותים שייכות לחברה בלבד.
12. דין וסמכות שיפוט
על תקנון זה יחול הדין הישראלי בלבד.
סמכות השיפוט הבלעדית נתונה לבתי המשפט בתל אביב.

TERMS AND CONDITIONS – STEREOIMAGE
Introduction
Welcome to STEREOIMAGE.
By using the Company's website or services, you agree to these Terms and Conditions.
These Terms apply equally to all genders.
1. Services
1.1 The Company provides recording, filming, editing, and content delivery services.
1.2 All bookings are subject to studio availability.
1.3 Services may only be purchased by adults with a valid payment method.
1.4 The Company reserves the right to refuse, suspend, or discontinue services at its sole discretion.
2. Payments
2.1 Payments shall be made according to the booking agreement or payment link.
2.2 Late payments will not be accepted unless approved in advance.
2.3 No services will be provided before full payment has been received.
2.4 Unless otherwise stated, all prices exclude VAT.
3. Cancellations
3.1 Recording sessions may be cancelled or postponed up to two full calendar days before the scheduled session.
3.2 Cancellation up to two days before – full refund.
3.3 Cancellation one day before – 50% refund.
3.4 Cancellation on the recording day – no refund.
3.5 No refunds will be issued for services already performed.
Company Cancellation
3.6 The Company may cancel or postpone a booking with at least two hours' notice.
3.7 In such cases, the client may choose either a full refund or an alternative booking date.
3.8 Such remedy shall constitute full and final compensation.
4. Client Delays
4.1 Clients must arrive on time.
4.2 Any delay counts as part of the booked session.
4.3 No refunds or extensions will be granted due to late arrival.
4.4 The Company is not obligated to extend lost recording time.
4.5 Delays exceeding 30 minutes without prior notice may be treated as a no-show.
4.6 In such cases, the Company may cancel the session without refund.
5. Delivery of Materials
5.1 Raw recordings will be delivered within 7 business days.
5.2 Edited projects will be delivered within 14 business days after receiving the client's revision notes.
5.3 Each revision cycle restarts the delivery timeline.
6. File Retention and Client Responsibility
6.1 All audio and video recordings are retained for up to 30 calendar days.
6.2 Files are permanently deleted after this period.
6.3 Clients are solely responsible for downloading and backing up their files.
6.4 Download speed and transfer quality depend on the client's internet infrastructure.
6.5 Receipt of the files constitutes confirmation that they were delivered satisfactorily.
6.6 The Company shall not be liable for any direct or indirect damages arising from file loss, including financial, commercial, or reputational damages.
6.7 Temporary, preview, or draft files may be deleted before the 30-day retention period expires.
7. Privacy
7.1 Personal information is used solely for providing the services.
7.2 Information will not be shared with third parties unless required by law.
7.3 The Company implements reasonable security measures.
7.4 The Company may block users in cases of misuse.
8. Marketing Use
8.1 Booking approval constitutes consent to use recorded materials for the Company's marketing purposes.
8.2 Clients may object in writing within five business days after the recording.
8.3 If no objection is received, full consent shall be deemed granted.
9. Recording Packages
9.1 Packages are prepaid hourly products.
9.2 Unused hours are non-refundable, non-transferable, and cannot be extended.
9.3 Packages may be cancelled within 14 days provided they have not been used.
9.4 Partial use will be calculated according to the regular hourly rate.
9.5 Cancellation one day before the session will deduct one package hour.
9.6 Cancellation on the recording day will be considered a used hour.
9.7 Packages are personal and non-transferable.
9.8 Packages are prepaid products and not subscription services.
10. Security Situation and Force Majeure
10.1 Services are subject to instructions issued by the Home Front Command, Israeli Police, and any competent authority.
10.2 The Company may postpone, modify, shorten, or cancel services due to security events, emergencies, infrastructure failures, movement restrictions, force majeure, or any circumstances beyond its reasonable control.
10.3 The Company's standard cancellation policy remains in effect, while each request will be evaluated according to the circumstances.
10.4 The Company does not guarantee uninterrupted service, studio availability, recording quality, raw material integrity, or the proper operation of electricity, internet, communication, or technical systems.
10.5 The Company shall not be liable for interruptions, delays, quality degradation, data loss, raw material loss, or any damages resulting from security events or force majeure.
10.6 In the event of a siren or emergency, the Company may immediately stop the recording session and instruct clients to move to a protected area or evacuate.
10.7 Such events shall not entitle the client to compensation, refunds, or any other claims.
10.8 The Company may, at its sole discretion and subject to availability, offer an alternative completion session.
10.9 Clients acknowledge that attending the studio during such periods is entirely at their own risk.
11. Intellectual Property
All intellectual property rights relating to the Company's website, content, and services remain the exclusive property of the Company.
12. Governing Law
These Terms shall be governed exclusively by the laws of the State of Israel.
Exclusive jurisdiction shall lie with the competent courts of Tel Aviv.
